I’ve got to say I’m impressed.  This is the first company to make a buyout offer.  I’ll have to do my due diligence.

Transferring to verification so they can make sure Val didn’t promise me a Hummer.  I’m not quite sure why I need verification.  But I’ll go along with it.  Val seems like a nice enough bloke. 

Ashley Wheeleer in verification.  Agreement is custom built and is also the receipt.  7 day cancellation period. 

So, verification really means getting my credit card number.  Why am I not surprised. 

She’s sending me an agreement to review, and then Val will follow up.  Cool.

Okay, Val emailed me the following:

100% Money Back Guarantee: We will refund 100% of your marketing fee if you or any other company SELLS or RENTS your vacation property at original asking price. A full refund will be granted upon proof of Sale or Rental.

ITA AGREEMENT is where I got this from. 

The operative phrase here is, “original asking price.”  That’s total BS. 

1. I can pay not $1164 but a discounted $764 to have them try to sell my timeshare and get me some rentals for 90 days.
2. After 90 days, I do NOT get my money back, but they will extend my contract so they will continue to market my timeshare for another 365 days.
3. If I sell my timeshare at the listed price, they refund me my money.

Now here are a few things that strike me odd.

I told Jim, “Let me make myself perfectly clear.  If you promise to return my money after a period of time if my timeshare hasn’t sold, we have a deal.”

To this he said that the Department of Agriculture and Commerce won’t let him do that. 

He must really think I’m stupid.  I’ve studied contract law in a b-law class, and I think you can pretty much put anything you want in an agreement so long as it’s legal.  What he really means to say is…

We want your money, and if we don’t do anything for 90 days, we want the option to continue to do nothing for you for another 365 days.  

But to his credit, he did tell me over and over, that I can call up my credit card company and contest the charge and get my money back.  If I were his merchant account company, I’d pull the plug on their account if they’re using their merchant account in lieu of a refund policy.

Here are a few good ones:

• They have a “Priority One on points” (rather than weeks) so my sale will be quick.
• I’ve been “pre-approved for billing.”  (I need approval to give you money????)
• He guarantees a “bone fide offer within 90 days.”  (Or they have to keep on trying.  Or not keep on trying.)

So I reiterated that once he puts in writing that I get my money back if my timeshare doesn’t sell after a period of time, that we have a deal.  He got all pissy and I hear him tell someone in the background to put me on their “do not call” list.

Jim, I’m going to miss you.  You showed promise.

And it’s too bad.  If you Google Jim Gibson timeshare, you get two results from www.complaintsboard.com and then this blog appears.  If he’d come through for me, I could have given him some really good press.

Needless to say, he started asking about my credit card, the expiration date and all.  I told him that no fool gives out a credit card number to an inbound call.  He assured me it’s safe. 

I made it crystal clear that he’ll get my credit card once I see something in writing.  (And I contact my credit card company to make sure I’ll get my money back after 90 days if he doesn’t deliver.)

He mentioned they sell timeshares to European corporations who want to take advantage of the strong Euro.  I can vouch for the fact that the USD doesn’t go far in Europe. 

He says they offer buyers 4.2% financing.

Sound all like a great deal.
